Ottawa police officer demoted for 12 months for having sex while on duty

An Ottawa Police Service officer is being demoted for 12 months in connection with a 2008 incident in which he had sex with a female civilian in her residence while on duty.

The penalty, in a decision posted online Monday, said Const. Richard Lemay would be demoted to second-class constable from first class after pleading guilty this past summer to disciplinary charges for discreditable conduct, neglect of duty and insubordination.

The demotion would take effect when Lemay returned to duty, said the decision authored by retired Ontario Provincial Police superintendent M.P.B. Elbers. Ottawa Police Service Board reports from 2024 said Lemay had been suspended on Feb. 5 of that year.

The discreditable conduct charge pertained to Lemay picking up the complainant in a marked police vehicle to drive her home and, while on duty and in uniform, entering her residence and engaging in sexual activity.

The neglect of duty charge involved Lemay failing to work in accordance with orders and leaving a “place of duty” without permission or sufficient cause and driving the complainant to her residence in a marked police vehicle while on duty and in uniform, then entering the residence for personal reasons.

The insubordination charge was laid because Lemay failed to properly secure and maintain control of his service firearm and “use of force options” while at the complainant’s residence.

The woman was identified only as AA in the disciplinary proceeding decision.

Lemay has been a member of the Ottawa Police Service since 2002. At the time of the disciplinary offences in the fall of 2008, he was with the patrol directorate.
